Welcome to Scoolsmart Hong Kong Ltd. By accessing and using our digital school management system (hereinafter referred to as the “Platform”), you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our services.

- 1.1 These terms govern the use of the Platform, services, and related offerings provided by Scoolsmart Hong Kong Ltd (hereinafter referred to as “we,” “our,” or “us”).
- 1.2 By registering for or using the Platform, you agree to these terms on behalf of yourself, your institution, or any organization you represent.
- 1.3 Scoolsmart reserves the right to modify or update these terms at any time. Continued use of the Platform constitutes your acceptance of any changes.
User Eligibility
- 2.1 The Platform is intended for use by authorized school administrators, staff, teachers, and students.
- 2.2 Users must provide accurate and complete information during registration and must notify us promptly of any updates to their details.
- 2.3 Unauthorized access or use of the Platform is strictly prohibited.
Scope of Services
- 3.1 Scoolsmart provides a comprehensive digital school management system, including but not limited to:
- Attendance tracking
- Fee management
- Academic performance analysis
- Communication tools
- Timetable scheduling
- 3.2 We reserve the right to enhance, modify, or discontinue specific features at our discretion without prior notice.
User Responsibilities
- 4.1 Users must maintain the confidentiality of their login credentials and restrict unauthorized access to their accounts.
- 4.2 Users are responsible for all activity conducted through their accounts.
- 4.3 Schools and administrators must ensure compliance with data protection laws and acquire necessary consent for processing student and staff data.
- 4.4 Misuse of the Platform, including uploading inappropriate, malicious, or illegal content, is strictly prohibited.
Intellectual Property
- 5.1 All intellectual property rights related to the Platform, including but not limited to software, content, and design, are owned by Scoolsmart Hong Kong Ltd.
- 5.2 Users are granted a limited, non-exclusive, non-transferable license to use the Platform solely for educational purposes.
- 5.3 Users may not reproduce, distribute, or modify any part of the Platform without prior written permission from Scoolsmart.
Privacy and Data Protection
- 6.1 Scoolsmart values the privacy of its users and adheres to applicable data protection laws.
- 6.2 By using the Platform, you consent to the collection, processing, and storage of data as outlined in our Privacy Policy.
- 6.3 Schools and administrators are responsible for securing any data they upload to the Platform and ensuring compliance with relevant laws.
Fees and Payment
- 7.1 Use of the Platform may be subject to subscription fees, as agreed upon in the service contract.
- 7.2 All fees must be paid promptly to avoid suspension or termination of access.
- 7.3 Refund policies, if applicable, will be outlined in the service agreement.
Limitation of Liability
- 8.1 Scoolsmart is not liable for any data loss, system downtime, or unauthorized access resulting from user negligence.
- 8.2 While we strive to provide uninterrupted and error-free services, we do not guarantee the availability or performance of the Platform.
- 8.3 Scoolsmart’s liability for any damages will not exceed the fees paid by the user for the relevant service period.
Termination
- 9.1 Scoolsmart may suspend or terminate access to the Platform for violations of these terms or misuse of the service.
- 9.2 Users may terminate their subscription by providing notice as per the service agreement.
- 9.3 Upon termination, users must cease all use of the Platform and delete any downloaded material related to the service.
Governing Law and Dispute Resolution
- 10.1 These terms are governed by the laws of Hong Kong.
- 10.2 Any disputes arising from the use of the Platform will be resolved through arbitration in accordance with the Arbitration Ordinance of Hong Kong. The venue for arbitration will be Hong Kong, and the language will be English.
Indemnification
- 11.1 Users agree to indemnify and hold Scoolsmart harmless from any claims, losses, or damages arising out of their use of the Platform or violation of these terms.
